Pentagon papers case defense attys on July 17 file affidavits by 3 persons with experience in handling classified material, who say they believe that jurors who have or have had security clearances would tend to be prejudiced against defendants Ellsberg and Russo; Fed Dist Judge Byrne nears completion of questioning of 2d panel of 16 prospective jurors; as juror selection progresses it appears certain that jury will contain some strong critics of Vietnam war since prosecution does not have enough peremptory challenges left to eliminate all those with anti-Vietnam sentiments

Fed Dist Judge Byrne on July 18 grants defense motions to disqualify prospective jurors R D Duenckel and T O Meadows Jr because they appear to have special expertise in security matters as result of their aircraft indus jobs; refuses to disqualify D W Silver, challenged 'for cause' by defense on ground that he once went through 'top secret' indoctrination by army; Govt later exercises 4 of its 5 remaining peremptory challenges, and defense expends 10 of its 12 remaining challenges; Ellsberg says in affidavit filed earlier that he once held such high security clearances that in '64 he was permitted to read series of Joint Chiefs of Staff crisis studies whose existence was kept secret from Defense Sec McNamara; gist of affidavit is that handling of classified materials varies widely from place to place, and that persons with security clearances should be excluded from jury because they might be 'shocked' by handling of classified material that would be proper under some ground rules; Byrne rejects defense demands that he question FBI agents who have been gathering information on potential jurors for Govt's counsel; defense asserts that agents may be improperly passing along data from FBI's secret dossiers in Washington, or from other sources that should be equally available to defense

Assn of Amer Publishers chmn R L Bernstein denounces attempt by US Justice Dept to prosecute Beacon Press for publishing Sen Gravel's version of Pentagon papers, s, July 17 meeting, NYC; says if Govt presses criminal charges filed against Beacon in Jan '72 it would pose 'huge threat to book publishing in the US'; calls for $100,000 Beacon Press defense fund; recommends that Random House, where he is pres, contribute $2,500; Unitarian Universalist Assn pres Dr R N West accuses Govt of using grand jury proceedings 'to create the same chilling effect on dissent in the 1970's that Sen Joseph McCarthy sought in the 1950's'; says that within last 2 wks Beacon Press editor-in-chief has been served subpoena by FBI to appear as witness at trial of Ellsberg and Russo, accused of releasing Pentagon papers to press; says similar subpoena has been issued to MIT Press dir H T Webber, who was offered Gravel's manuscript in summer of '71 but turned it down; says subpoena calls for all documents dealing with Gravel's offer
