Fed Dist Judge W M Byrne, presiding over Pentagon papers trial, on Apr 26 sends jury home after discovering that Govt has again withheld evidence from ct and defendants; incident is 2d during trial in which jury was sent home; asst prosecutor W B Reese tells ct that there is no conscious or deliberate effort on prosecution's part to withhold material, which consists of ints by FBI agents and other Govt investigators of several Rand Corp employes, including R Moorstein, R H Best and J Butler; excusal of jury involves type of material referred to as 'Jencks' material, which derives its name from case involving C E Jencks, NM labor leader who was convicted in Jan '54 of falsely signing non-Communist affidavit under Taft-Hartley Act; conviction was appealed to Sup Ct, which ruled 7-to-1 on June '57 that FBI repts that formed basis of testimony by Govt witnesses in criminal trials must be turned over to defense or case must be dismissed; Cong in '57 passed Jencks Act, which said that only authenticated or substantially verbatim pretrial ints by prosecution witnesses have to be given to defendants and those ints have to have direct bearing on witnesses testimony

Sen E S Muskie, charging that Nixon Adm's attitude toward govt secrecy represents 'nightmare for democracy,' calls on Apr 25 for new Cong controls over classified documents; says that Pres Nixon has not gone far enough in reforming calssification system and that Cong must take positive action to undo Govt secrecy; White House issues rept on Apr 24 in which Interagency Classification Rev Com cited 63% reduction in number of officials authorized to stamp documents top secret, secret or confidential, and says that millions of documents have been declassified after rev; Muskie notes that 18,000 officials can still classify information and there is no way to determine if they are doing so properly
Caramanlis Says He'd Return To Athens to Defend Publishers

former Premier C Caramanlis notifies friends in Athens that he would return to Athens to defend any newspaper publishers put on trial for printing his declaration attacking Greek dictatorship; no publishers have been charged so far, but Greek judges are issuing contradictory rulings on seizure of newspapers; judicial council in Athens confirms ban on newspaper Vradyni on Apr 24 on ground that statement it published was 'incitement to subversion'; similar 3-judge council in Salonika on Apr 25 orders ban lifted on local sales of Vradyni as well as on local paper Thessaloniki, terming Caramanlis text 'not a minifest incitement to rebellion'; other council in Athens on Apr 25 cancels seizure of Athens News because it readership is mostly foreign; lawyers for Vradyni say they will appeal against ruling of council, which described Caramanlis declaration as 'aiming at overthrow of the established constitutional order' and seeking to 'induce discontent and animosity against the prevailing pol order'; qualified observers believe no further action will be taken against pub of Caramanlis's declaration because he would also have to be indicted along with execs of newspapers; note Govt is unlikely to risk Caramanlis's return to Athens to face trial because it might create problems for public order; Apr 24 issues of Internatl Herald Tribune and Le Figaro, which extensively reptd Caramanlis statement, were not available at many Athens newsstands, but venders say papers had been withdrawn by distributing agency; Greek press dept spokesman says Govt never obstructs circulation of foreign newspapers and that move had probably been due to private initiative
